Unsolicited Product Submission Policy
USER COMMENTS, FEEDBACK, AND SUBMISSIONS
All comments, feedback, suggestions, ideas, and other submissions disclosed, submitted, or offered to Medifast on or by this Site or otherwise disclosed, submitted, or offered in connection with the sender’s use of this Site or otherwise (collectively, “Comments”) shall be and remain Medifast’s property. Such disclosure, submission, or offer of any Comments shall constitute an assignment to Medifast of sender’s all worldwide rights, titles, and interests in all copyrights and other intellectual property contained in the Comments. Thus, Medifast will own exclusively all such rights, title, and interest and shall not be limited in any way in its use, commercial or otherwise, of any Comments. Medifast is and shall be under no obligation (1) to maintain any Comments in confidence; (2) to pay to sender any compensation for any Comments; or (3) to respond to any Comments.
The sender agrees that Medifast may use and/or disclose information about your demographics and use of the Site in any manner that does not reveal your identity. By participating in Site contests, promotions, and/or requesting promotional information or product updates, you agree that Medifast may use your information for marketing and promotional purposes.
PRODUCTS/IDEAS SUBMITTED TO THE COMPANY
Medifast values creativity and innovation. However, please note that many of the unsolicited products or ideas that we receive are not novel or original and have already been or are being considered internally at Medifast. In order to avoid any misunderstanding, Medifast has adopted a policy with respect to the submission of products or ideas from outside sources (“Submitters” or “Submitting Parties”). To request a copy of the Product/Idea Submission Policy Letter, please click here. We ask that Submitters read the policy carefully before submitting their products or ideas. The submission of a product or idea confirms the Submitter’s agreement to the terms of the policy. The submitted product or idea will not be considered if it does not include a signed Product/Idea Submission Policy Letter, signifying the Submitter’s agreement to the terms therein.
By submitting an unsolicited product or idea to Medifast, please understand that the Submitting Party is voluntarily disclosing its product or idea, which effectively waives any right to confidentiality regarding the submitted product or idea. In other words, the product or idea submission does not create a confidential relationship between the Submitting Party and Medifast. If Medifast has already come up with a similar product or idea internally, or if the product or idea is of no interest to Medifast, the submission will be returned to the Submitter or destroyed if not feasible to return. Due to the large amount of product and idea Submissions sent to Medifast annually, Medifast is under no obligation to return any materials submitted to it.
If the submitted product or idea is novel or original and of possible interest to Medifast, the Submitting Party will be contacted to further discuss the submission. By submitting a product or idea, the Submitting Party understands that it is not entitled to any compensation for the product or idea. Medifast does not, nor should the Submitting Party, view the submission of a product or idea as an offer to do business with Medifast. Medifast will have no obligation to reveal to the Submitting Party, or update the Submitting Party on, its activity in connection with the submission or its consideration of it. Medifast encourages Submitters to protect themselves and their ideas to their own satisfaction before submitting the ideas through this process.
